Digital Millennium Copyright Act Notice and Policy
TikShots respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), TikShots will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
Copyright Infringement Notification
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our TikTok Download service, please notify our copyright agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:
1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
2. Identification of the copyrighted work that you claim has been infringed;
3. Identification of the material that is claimed to be infringing and where it is located on the TikShots TikTok Download service;
4. Information reasonably sufficient to permit TikShots to contact you, such as your address, telephone number, and email address;
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law;
6. A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.
DMCA Takedown Procedure
Once we receive your infringement notification, we will respond expeditiously to:
– Remove or disable access to the content claimed to be infringing
– Notify the content provider, member, or user that we have removed or disabled access to the content
– Terminate repeat infringers’ accounts in appropriate circumstances
Counter-Notification Procedure
If the content provider, member, or user believes that the content that was removed or to which access was disabled is either not infringing, or the content provider, member, or user believes that they have the right to post and use such content from the copyright owner, the copyright owner’s agent, or pursuant to the law, the content provider, member, or user may send a counter-notice containing the following information to our copyright agent:
1. A physical or electronic signature of the content provider, member, or user;
2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
3. A statement that the content provider, member, or user has a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content;
4. The content provider’s, member’s, or user’s name, address, telephone number, and email address, and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the content provider’s, member’s, or user’s address is located, or if the content provider’s, member’s, or user’s address is located outside the United States, for any judicial district in which TikShots is located, and that such person or entity will accept service of process from the person who provided notification of the alleged infringement.
If a counter-notice is received by our copyright agent, TikShots may send a copy of the counter-notice to the original complaining party informing that person that we may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at TikShots’ sole discretion.
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, TikShots has adopted a policy of terminating, in appropriate circumstances and at TikShots’ sole discretion, users who are deemed to be repeat infringers. TikShots may also at its sole discretion limit access to the TikTok Download service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
